All items must be removed by this time frame-should your item(s) not be removed you forfeit your money and purchase-NO REFUNDS. The Seller and Auction Company shall be held harmless by all registered Bidders for their failure to abide to Seller's removal terms.

The following Conditions of Sale, as amended by any posted notices or verbal announcements during the sale, constitute the entire terms and conditions on which property listed in the catalog shall be offered for sale or sold by The Michael Angelo Auction Company. And any consignor of such property for whom we act as agent. As used wherein, “The Michael Angelo Auction Company” “we” and “us” refer to The Michael Angelo Auction Company.

1.) As used herein, the term "bid price" means the price at which a lot is successfully sold to the purchaser. The term "purchase price" means the aggregate of (a) the bid price.

2.) The highest bidder shall have purchased the offered lot in accordance with all of the conditions set forth herein and (a) assumes full risk and responsibility therefore, (b) if requested will sign a confirmation of purchase in-person or by registering for this live and online auction, and (c) will pay the purchase price in full or such part as we may require for all lots purchased. No lot may be transferred. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to us and the consignor by law, including without limitation, the right to hold the purchaser liable for the purchase price, we at our option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property, either publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs and expenses of both sales, our commission at our standard rates, all other charges due hereunder, attorneys’ fees and incidental damages. If all fees, commissions, bid price and other sums due to us from the purchaser are not paid promptly as provided in these Conditions of Sale, we reserve the right to impose a finance charge equal to 1.5% per month on all amounts due to us beginning on the 31st day following the sale until payment is received, in addition to other remedies available to us by law.

3.) EVERYTHING MUST BE PAID IN FULL ON THE DAY OF THE AUCTION regardless of when it is picked up. Items that are being shipped by Bidder/Their Carrier or Sub-Contractor will be shipped by their employed services and hereby authorizes the Seller to release items on their behalf. We reserve the right to withdraw any property at any time before the actual sale-inventory is subject to change.

4.) We reserve the right to reject a bid from any bidder. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales records shall be conclusive in all respects.

5.) If a lot is offered subject to a reserve, we may implement such reserve by bidding on behalf of the
consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. If we have an interest in an offered lot and the proceeds there from other than our commissions, we may bid therefore to protect such interest. CONSIGNORS ARE NOT ALLOWED TO BID ON THEIR OWN ITEMS.

6.) All statements contained in the catalog or in any bill of sale, invoice or elsewhere as to authorship, period, culture, source, origin, measurement, quality, rarity, provenance, importance, exhibition and literature of historical relevance, or physical condition ARE QUALIFIED STATEMENTS OF OPINION AND NOT REPRESENTATIONS OR WARRANTIES. No employee or agent of The Michael Angelo Auction Company is authorized to make on our behalf or on that of the consignor any representation or warranty, oral or written, with respect to any property.

7.) All purchased property shall be removed from the premises at which the sale is conducted by the date(s) and time(s) indicated for the event. The Michael Angelo Auction Company will not handle shipping out of state Internet purchases unless notified in advance of the auction date. There is an additional handling charge for materials and labor-not included in bid price. A storage fee of $25 per day, per lot, if pickup is not within the listed removal pickup time frame. If items are not picked by the 9/1/2011 deadline date of the auction, buyer forfeits the item(s) and any monies paid.

8.) Invalid or unapproved credit card purchases will be subject to a $50 processing fee for late payment if paid on the first business day following the auction. If the auction proceeds are collected later than the following business day after an auction, an additional daily fee will be added of $10 per day. Failure to pay within five days of the end of the auction will ban the bidder from participating in any other The Michael Angelo Auction Company online auctions. Note: We shall prosecute any bidder that fails to make payment in full within listed time frame after auction end. It does not matter what State you live in-we'll be there.

9.) The copyright in the text of the catalog and the photographs, digital images and illustrations of lots in
The catalog belongs to The Michael Angelo Auction Company or its licensors. You will not reproduce or permit anyone else to reproduce such text, photographs, digital images or illustrations without our prior written consent.

10.) It is the sole responsibility of the Internet bidder to be familiar with the Internet bidding process. The uploaded results of the auction take precedence over any and all messages of high bids during proxy and live bidding. LIVE INTERNET BIDDERS ARE ADVISED TO HAVE A DSL OR HIGHER INTERNET CONNECTION TO BID DURING THE LIVE AUCTION – Because of the fast paced nature of the auction a slower connection could lead to not being able to bid on the items that you are interested in. Please leave proxy bids for the auction if you are uncomfortable bidding during the live event.

11.) Example only and subject to change-Bidding is in increments of $2.50. So if you place a bid of $11, your bid will only be represented up to $10. Also if you place an opening bid of $10 and then a max bid of $12.50, your bid will be represented at $12.50 since there is no intervening bid increment available, so your max bid should be at least $5 more than your opening bid, i.e. opening bid = $10, max bid = $15. Please bid accordingly. Bids under $50 work in $2.50 increments; Bids above $50, but under $100 work in $5.00 increments; Bids above $100 but under $500 work in $10.00 increments; Bids above $500 but under $1,000 work in $25 increments; Bids above $ 1,000 but under $5,000 work in $50.00 increments and bidding up to $100,000,000 work in $100.00 increments.
12.) You are participating in an Internet auction as an Internet bidder which means that bids will be accepted from the Internet and from the auction floor. All bids from the auction floor will be posted to the Internet for competitive bidding from Internet bidders.

13.) These Conditions of Sale shall bind the successors and assigns of all bidders and purchasers and insure to the benefit of our successors and assigns. No waiver, amendment or modification of the terms hereof (other than posted notices or oral announcements during the sale) shall bind us unless specifically stated in writing and signed by us. If any part of these Conditions of Sale is for any reason invalid or unenforceable, the rest shall remain valid and enforceable.

14.) These Conditions of Sale and the purchaser’s and our respective rights and obligations hereunder are governed by the laws of the State of Ohio. By bidding at an auction, each purchaser and bidder agrees to be bound by these Conditions of Sale. Any dispute, controversy or claim arising out of or relating to this agreement, or the breach, termination or validity thereof, brought by or against The Michael Angelo Auction Company (but not including claims brought against the consignor by the purchaser of lots consigned hereunder) shall be resolved by the procedures as set forth.

14A.) GOVERNING LAW, JURISDICTION AND VENUE. The laws of the State of Ohio (without giving effect to its conflict of laws principles) govern all matters arising out of or relating to this Agreement and the transactions it contemplates, including, without limitation, its interpretation, construction, performance, and enforcement. Except as set forth below concerning arbitration, any claims or actions regarding or arising out of this Agreement shall be brought exclusively in a court of competent jurisdiction sitting in Cincinnati, Ohio, and each party to this Agreement submits to the nonexclusive jurisdiction of such courts for the purposes of all legal actions and proceedings arising out of or relating to this Agreement. Each party waives, to the fullest extent permitted by law, any objection that it may now or later have to the laying of avenue of any legal action or proceeding arising out of or relating to this Agreement brought in any state or federal court sitting in Cincinnati, Ohio; and any claim that any action orproceeding brought in any such court has been brought in an inconvenient forum.

14B.) DISPUTE RESOLUTION. Any controversy or claim arising out of or relating to this Agreement, or any breach thereof, must be settled by confidential binding arbitration in Cincinnati, Ohio, in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Either party may, without inconsistency with this agreement to arbitrate, seek from a court any provisional remedy that may be necessary to protect trademarks, copyrights, or other rights or property pending the establishment of the arbitral tribunal or its determination of the merits of the controversy.

14C.) RECOVERY OF LITIGATION COSTS. If any legal action or other proceeding is brought pursuant to or in connection with these terms or any transaction involving you and The Michael Angelo Auction Company, then, if The Michael Angelo Auction Company is the prevailing party, it is entitled to recover from you its reasonable attorneys' fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

15.) Internet Bidder agrees and acknowledges that all purchases made from this auction website will be charged to their credit card on the day of the auction under $1500.00. Placing bids on items offered in this auction will bind the cardholder to all the terms and conditions of this auction and cardholder terms and conditions.

16.) If you pick up your merchandise in person at one of our auction locations, you need to inspect your item(s) to insure they match the description of the item. If there is a dispute about the item, it must be handled at the time of pick-up in the presence of a The Michael Angelo Auction Company's team member.

17.)DISPUTE BETWEEN BIDDERS/BID INCREMENTS - If any dispute arises between two or more bidders, the Auctioneer may decide the same or put the lot up for sale again at once, or resell to the highest bidder. Auctioneer may reject a nominal or fractional bid advance if, in his estimation, it proves injurious to the sale. The Auctioneer's decision shall be final and absolute.

18.) ADDITION TO OR WITHDRAWAL FROM SALE - The Auctioneer reserves the right to alter the order of the sale, withdrawal from the sale any of the property listed or to sell at this sale property not listed, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. Whenever the best interest of the Seller will be served, the Auctioneer reserves the right to sell property listed, in bulk.

19.) RISK TO PERSON AND PROPERTY - Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the Auctioneer from liability therefore. Neither the Auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held.

20.) CONDITION OF ARTICLES SOLD - The Auctioneer shall not be responsible for the correct description, genuineness, authenticity of, or defect in any lot, and makes no warranty in connection therewith. No sale will be set aside nor allowance made on account of any incorrectness, error in commentary, cataloguing, or any imperfection not noted. No deduction allowed on damaged articles, all goods being exposed for public exhibition are purchased and accepted by Buyer "AS IS", "WHERE IS" and "WITH ALL FAULTS". Auctioneer makes no warranties or guarantees whatsoever whether written, oral or implied as to quality, quantity, condition, usability , salability, weight, measurement, year, model, model, mechanical condition, performance or other specifications and without recourse. All items offered shall not include a coin mech, keys or locks and Seller nor Auction Company responsible for removing any locks from items.
21.) CLAIMS - No Claims will be allowed after removal of goods from premises by bidder or authorized shipping agent handled through registered bidder.
22.)RESPONSIBILITY FOR NON-DELIVERY - Auctioneer shall not, in any event, be liable for non-delivery or for any other matter or thing, to any Buyer of any lot, other than for the return to the Buyer of the deposit or sum paid on said lot, should the Buyer be entitled thereto.
23.) RESERVE - The Auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the Auctioneer shall have the right to bid on behalf of the Seller.
24.) ADDITION TO OR WITHDRAWAL FROM SALE - The Auctioneer reserves the right to alter the order of the sale, withdrawal from the sale any of the property listed or to sell at this sale property not listed, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. 25) NO refunds or chargeback's will be granted due to a lack of removal at the designated times. After the scheduled removal, items will be considered abandoned and you will be charged a removal fee for dispose of your items.
We accept Cash, Wire Transfer Major Credit Cards-the credit card must be in bidder/buyer's name and a credit card authorization from shall be faxed to you to be filled out and faxed back to us. Credit Card Limited to $1,500.00 purchase price and any purchases above that amount SHALL BE REQUIRED TO BE PAID BY WIRE TRANSFER FROM YOUR BANK TO OUR ACCOUNT. All sales final-no refunds or chargeback's allowed.
26.) CONDITION OF ARTICLES SOLD - The Auctioneer shall not be responsible for the correct description, completeness, genuineness, authenticity of, or defect in any lot, and makes no warranty in connection therewith. No sale will be set aside nor allowance made on account of any incorrectness, error in commentary, cataloguing, or any imperfection not noted. No deduction allowed on damaged articles, all goods being exposed for public exhibition are purchased and accepted by Buyer "AS IS", "WHERE IS" and "WITH ALL FAULTS". Auctioneer makes no warranties or guarantees whatsoever whether written, oral or implied as to quality, quantity, condition, usability , salability, weight, measurement, year, model, model, mechanical condition, performance or other specifications and without recourse. The Seller shall provide no locks, keys or coin mech's for any item sold and should a machine have a lock without a key it is solely the responsibility of the Bidder for removing the lock at their cost of time or materials.
The machines sold are used and have been subjected to daily wear & tear and depending on unit show knicks, chips, cracks, missing pieces, cabinet damage or more. The arcade machines that may be linkable from the manufacturer are not linked tested during the auction and not guaranteed to include link cables and should one not be included Bidder/Buyer shall solely handle burden of costs.
27.) RESERVE - The Auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the Auctioneer shall have the right to bid on behalf of the Seller.
28.)COMPLIANCE WITH TERMS OF SALE - In default of payment of bills in full within the time therein specified, the Auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. Lots not paid for and removed within the time allowed herein may be resold at public or private sale without further notice, and any deficiency, together with all expenses and charges of re-sale, will be charged to the defaulting purchaser.
Note: Payment must be paid in full prior to pick-up from this listed location(s).
LIABILITY: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price only.
Any Lot Number(s) not sold during auction and registered Bidder wishes to make an offer after the auction is still bound by all auction Terms & Conditions. Auctioneer and Seller(s) shall retain right of refusal on any and all offers. A Buyers Premium shall apply to any lot sold Live Auction or Internet Real Time Bidding or sold after the auction.
